From the date of service, California law imposes a mandatory six-month waiting period before a court can finalize the divorce, regardless of how quickly both parties reach agreement.

If immediate financial support or a parenting schedule is needed before the case resolves, the filing spouse can request temporary orders shortly after the petition is filed. After service, the responding spouse files a Response addressing property and debt division, custody and visitation, and support.

Contested vs. Uncontested: When spouses don’t agree on all issues, mediation is often the next step before a judge rules on any disputed matters. Once terms are settled, an Order of Dissolution is submitted to the court for approval. An uncontested divorce, where both parties agree on every major issue, may move through the process more quickly than a contested case.

For couples married fewer than five years who meet specific criteria, including no real property ownership and no minor children, California also permits a streamlined option called a summary dissolution.
